The Regulated Industries practice group represents energy, transportation and telecommunications clients in transactional, administrative and litigated matters before state and federal courts as well as state and federal agencies.
Our attorneys have experience in administrative litigation, settlements, ISO disputes, certificate proceedings, rule makings, acquisitions, financing, changes in regulation and deregulation. We provide counseling to energy producers, transporters, marketers, distributors, service providers and users, and railroads, as well as various types of communications providers, ISPs and other telecommunications users in connection with regulatory compliance and matters impacting acquisitions, divestitures and financings. We often help our clients draft and negotiate contracts and appear, on their behalf, before state and federal legislative committees.

We represent Canadian Pacific Railway, headquartered in Calgary, Alberta, and act as its lead counsel on U.S. legal matters. We handle the company’s general contracts, also real estate transactions, environmental, regulatory and employment matters. We advise in general corporate matters involving U.S. subsidiaries and litigate before courts and regulatory agencies throughout the United States.
NRG Energy, Inc. and NRG Power Marketing Inc.
We represent NRG Energy and NRG Power Marketing and its subsidiaries before FERC, ISO-NE, NYISO and various state regulators in the northeastern United States. We also act as NRG Power Marketing’s contract administrator for power sales agreements and fuel-supply agreements in North America.
NorthWestern Energy, a Division of NorthWestern Corporation
We represent NorthWestern Energy before the FERC and the Montana PSC in matters involving power marketing and fuel procurement for retail energy and natural gas business, and in related litigation in state and federal courts.
Split Rock Energy, LLC
We act as outside general counsel for Split Rock Energy, the power marketing venture owned by Minnesota Power and Great River Energy.
Great Plains Natural Gas
We represent Great Plains before the Minnesota PUC in regulatory matters, including rate cases.
Midwest Wireless
We act as outside general counsel for Midwest Wireless, a licensed CMRS carrier and certificated competitive-niche service provider, including representation regarding FCC and state PUC regulation.
Rural Cellular Corporation
We represent RCC, a licensed CMRS carrier, in matters before the Minnesota Public Utilities Commission.
Other Energy Clients
We have represented various interstate pipelines in a variety of federal and state proceedings ranging from rate cases to pipeline development projects. We also represent independent power producers in obtaining necessary regulatory permits to construct electric generating facilities, including cogeneration facilities. Finally, we have represented large industrial consumers of energy in all aspects of energy procurement, including self-generation options.
