Employment and Labor Alert: NLRB Again Postpones Deadline for Private Employers to Notify Employees of Right to Unionize: New Deadline is April 30, 2012

On December 23, 2011, the National Labor Relations Board (NLRB) postponed until April 30, 2012 the deadline by which most private employers must notify employees of their right to unionize under the National Labor Relations Act. This is the second time the NLRB has postponed the deadline. Originally, the notice-posting rule was set to take effect on November 14, 2011. In October, the effective date was pushed back to January 31, 2012.

This time, the NLRB postponed the effective date of the rule at the request of a federal court in Washington, D.C., where several groups have filed a legal challenge to the rule. In a statement, the NLRB said that the postponement would allow for the resolution of the lawsuit.
